Dear Henry,
Is there a definitive way to determine the difference between a condo and a townhome? I have had some condos with lot sizes, and townhomes that show an undivided interst that the Mortgage and Tile Co. swear are townhomes. Not sure if our county just records them differently.

Every state now has laws that require a Condo deed to clearly indicate that it is a Condo. The only way to be sure is to look at the deed. Keep in mind it is possible to have a Condo within a PUD, and a free-standing Condo unit is not unheard of.
What makes a property a condo is the TYPE ownership, not the configuration of the property.
